A representative of the Rock Creek Hills Citizens’ Association said on the group's blog that it will appeal a judge's April 23 ruling against its complaint attempting to stop the move.

The association claims the judge was wrong in concluding it has no standing to challenge the school location and says there needs to be further review about whether the Board of Education has claim to the park.

"The association and the individual plaintiffs are appealing the April 23 order," association president John Robinson wrote. "In addition, the association’s park
litigation fund has accumulated a modest reserve for the initial phase of the appeal."

Montgomery County Public Schools spokesman Dana Tofig told the Gazette he was not aware of an appeal.
